Terms and conditions

Entry in this Competition constitutes your acceptance of these official rules.

  1. This competition is open to all. Entrants aged under 18 must obtain their parents’ and/or legal guardians’ permission to enter and those parents and/or legal guardians consent to be bound by these terms and conditions in their own right. Employees and their immediate families of the Promoter and its agencies associated with this competition are ineligible to enter.
  2. Eligible entrants enter the competition by completing the online competition entry form and uploading an appropriately themed image by the closing date of 5pm (UTC+12:00) 10 August 2012. Multiple entries per category are acceptable. Entry is only valid if all details in the online entry form are completed. Te Papa accepts no responsibility for lost, late or misdirected entries.
  3. In submitting your contribution you hereby warrant and undertake to Te Papa that;
    1. your contribution is your own original work and that you are fully entitled to grant to Te Papa the rights under Clauses 5 and 6 and that by doing so you do not violate, plagiarise, or infringe the rights of third parties including copyright, trade mark, trade secrets, privacy, publicity, personal or proprietary rights;
    2. you are not aware of any third parties who might be entitled to prevent Te Papa from exploiting the Copyright or from reproducing any of the items in your contribution or distributing copies thereof to the public;
    3. you will not submit any defamatory or illegal material of any nature. This includes text, graphics, video, programs or audio;
    4. you agree to indemnify Te Papa against all legal fees, damages and other expenses that may be incurred by Te Papa as a result of your breach of the above warranties;
    5. You will not submit anything intended to support or promote a business. This includes text, graphics, video, programs or audio.
  4. Te Papa respects your rights and does not claim copyright for works you submit to this contest. You will retain full copyright in each entry.
  5. By entering this contest you agree that any work you submit may be used by Te Papa (and its partners) solely for marketing and promotional purposes of this competition or future competitions and no other purpose, these uses include;
    1. Judging the competition,
    2. Displaying the entries on the competition website (and websites of partners),
    3. Displaying the entries at public exhibitions to promote the competition,
    4. Publishing the entries on posters to promote the competition,
    5. Cropping and re-sizing the work as necessary to fit pre-defined formats to promote the competition,
    6. Sub-licensing the entries to the press for reproduction in connection with the competition and any related exhibition,
    7. Inclusion within any materials promoting the competition or any exhibition of works from this competition organised by Te Papa.

For the avoidance of doubt displaying the entries at public exhibitions includes display in any Albatross themed exhibition organised by Te Papa only if the use promotes the competition. Clause 8 will apply to any additional uses not directly related to the competition including, but not limited to, use in exhibition graphic panels, audiovisuals, or other such exhibition use not directly related to the competition.

  1. You hereby grant Te Papa a non-exclusive, irrevocable, and worldwide licence in each Entry in all media for the uses described in 5 above.
  2. Should any uses of the work beyond those needed to promote the contest arise you will be contacted and given the opportunity to negotiate any such usage with the parties concerned independently of the competition.
  3. Te Papa respects your moral rights. Whenever your work is published by Te Papa (and its partners) you will be credited. Failure to publish a credit due to error or oversight shall not be deemed a breach of this condition.
  4. Te Papa reserves the sole right to remove any content that it deems unsuitable. This might include but not be limited to content that is unlawful, harassing, defamatory, abusive, threatening, harmful, obscene, profane, sexually oriented, racially offensive or otherwise objectionable.
  5. Te Papa reserves the right to use none, part or all of your submission and may delete any contribution published onto its website at any time.
  6. If you do not want to grant to Te Papa the above rights or cannot provide the warranties set out above, please do not enter this competition.
  7. The best entry and runners up for each category is determined by a panel of independent judges appointed by Te Papa. Te Papa reserves the right to change judges. Chance plays no part in determining the Category winners and runners-up. Category winners and runners-up will be notified by email before the announcement of the prizes on 12 August 2012. All decisions of the Promoter are final and no correspondence will be entered into.
  8. The prizes are not transferable or exchangeable and cannot be taken as cash. The Promoter accepts no responsibility for loss or damage to prizes in transit.
  9. Entrants agree that personal data entered during registration, including name, mailing address, phone number and email address may be processed, store, shared and otherwise used for the purposes and within the context of this Contest. Entrants have the right to access, review, rectify or cancel any personal data held by Te Papa in connection with the Contest by writing to Te Papa at the address listed below.
  10. Publicity: By entering the Contest, entrants agree to participate in any media or promotion activity resulting from the Contest and agree and consent to the use of their name and/or likeness by Te Papa for such media or promotional activity, unless prohibited by law.
  11. The Promoter reserves the right to amend or cancel any part of this promotion (including any term) in its sole discretion and without giving reasons.
