  1. The information ‘How to enter’ forms part of these Terms and Conditions.
  2. Conditions of prizes:
    1. The return flights to Wellington are only exiting Auckland, Hamilton, Christchurch and Dunedin and will be awarded according to seat availability.
    2. For the luxury car to be awarded the driver needs to have a Full NZ driver’s license and be over the age of 25 years and be covered by their insurance.
    3. The dinner at Martin Bosley’s Restaurant is a voucher to the value of $340 for a Degustation Dinner for 2 Guests – matched with wines.
  3. On entry into this promotion, you are deemed to have accepted these Terms and conditions. Entry is open to all residents of New Zealand except employees of the Museum of New Zealand Te Papa Tongarewa or Positively Wellington Tourism, their agencies and immediate families.
  4. The Promoter is the Museum of New Zealand Te Papa Tongarewa ("the Promoter").
  5. SMS entry is open to Telecom NZ 025 and 027 and Vodafone/Telstra Clear 021 and 029 customers. Customers on international roaming are ineligible to enter. The Promoter reserves the right to provide information about your participation to either Vodafone or Telecom NZ.
  6. You must be the owner of the mobile phone to enter via text messaging.
  7. The Promoter accepts no responsibility for late, lost, or misdirected entries.
  8. Travel and all incidental costs associated with claiming the prize are the responsibility of the winner.
  9. The prize is not transferable, exchangeable, or redeemable for cash. In the event that a prize becomes unavailable for reasons beyond the Promoter’s control, the Promoter may, at its sole discretion, substitute a prize of equal or greater value.
  10. If the winner cannot be contacted, the prize will be redrawn.
  11. Upon notification, the prize winner has 24 hours to confirm and accept the prize.
  12. The winner must be available for publicity and promotional purposes.
  13. This promotion commences Wednesday 15 July 2009. Entries close at 6pm New Zealand time Sunday 1 November 2009. The winner will be drawn Monday 2 November 2009. The winner will be notified via phone by 5pm New Zealand time. The winner’s name may also be published on the Te Papa website www.tepapa.govt.nz, the Te Papa Facebook page http://www.facebook.com/TePapa and in any associated newsletters of Te Papa.
  14. A Te Papa representative will contact the winner by telephone on the mobile number the entry was received.
  15. The judge’s decision is final and no correspondence will be entered into.
  16. For the avoidance of doubt, whomever the Promoter contacts or is contacted by, as the case may be, must inform the Promoter who the owner of the mobile phone is. In case of mobile ownership dispute over a prize claim, it is the responsibility of the owner to prove, at their sole cost, such ownership.
  17. If the winner of the prize is under the age of 18 years, the prize will be awarded to the winner’s nominated parent or guardian.
  18. The Promoter and its agents are not responsible for any loss or damage whatsoever that is suffered (including but not limited to indirect or consequential loss) or for personal injury suffered or sustained during the course of the promotion, or accepting or using the prize.
  19. The Promoter may use the information obtained from the entrants for future mobile phone correspondence. All personal information obtained from the entrant will remain confidential and will not be provided to any third party without the entrant's consent except as required by law.

SMS entry and entry confirmations

  1. All entries are deemed to be received at the time of receipt into the Promoter's database, NOT at the time of transmission by the entrant.
  2. The eventual delivery of SMS messages is largely dependent on additional parties and the effective functioning of the sender's mobile operator's systems and infrastructure. Consequently the Promoter will not be liable for non-receipt of or late receipt of messages.
  3. The use of any automated entry software or any other mechanical or electronic means that allows an entrant to automatically enter the competition repeatedly is prohibited and will render all entries submitted by that entrant invalid.
  4. The Promoter is not responsible for any incorrect or inaccurate information, or for any fault of the equipment or programming associated with or utilised in this competition, or for any technical error, or any combination thereof that may occur in the course of the administration of this competition including any omission, interruption, deletion, defect, delay in operation or transmission, communications line failure or telephone, mobile or satellite network failure, theft or destruction or unauthorised access to or alteration of entries.
  5. If for any reason this competition is not capable of running as planned, because of such things as (including but not limited to) technical failures, unauthorised intervention, fraud or any other cause beyond the control of the Promoter which corrupts or affect the administration, security, fairness, integrity or proper conduct of this competition, the Promoter reserves the right at its sole discretion to cancel, terminate, modify or suspend the competition.  The Promoter reserves the right to disqualify any individual who tampers with the entry process.
  6. All correct entries received in the promotion are intended to receive a reply confirmation message. In times of high entry volumes some delays may occur in the delivery of this reply message. The Promoter will endeavour to provide all confirmation text messages promptly, however, successful delivery depends on additional parties such as telecommunication network suppliers and ISPs, and the Promoter provides no guarantee that messages will arrive promptly or at all. Message delivery performance also depends on the recipient's mobile terminal being switched on and located within an area that is acceptably covered by the recipient's services provider and, mobile operators can prevent their subscribers from receiving SMS messages, for whatever reasons, and in such cases message delivery is not possible. The Promoter and its partners will not be held responsible for any loss or damages whatsoever arising from the receipt or non-receipt of text messages.
